We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
NourishNest provides informational content about infant and toddler nutrition. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Content is based on published guidelines from the American Academy of Pediatrics (AAP), World Health Organization (WHO), and Centers for Disease Control and Prevention (CDC), but should not replace consultation with your child's pediatrician, allergist, or registered dietitian.

You must be at least 18 years of age to create an account and use the Service. By using NourishNest, you represent that you are a parent, legal guardian, or authorized caregiver of any child whose information you provide to the Service.

All content and materials available through the Service — including text, graphics, logos, food database entries, meal plan algorithms, recipes, user interface designs, and software code (collectively, "Content") — are the property of NourishNest or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include:
You may submit content through the Service, including recipes, meal notes, and community posts ("User Content"). By submitting User Content, you grant NourishNest a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content in connection with operating and improving the Service.
You retain ownership of your User Content and may delete it at any time. Upon account deletion, your personal User Content will be removed. Community-shared recipes may be retained in anonymized form.
NourishNest may offer free and paid subscription tiers. If you subscribe to a paid plan:
You may delete your account at any time through the app (Profile → Privacy → Delete My Account). Upon deletion:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless NourishNest and its affiliates, officers, agents, and employees from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or infringement of any third party's rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute arising under these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in Delaware. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
If you believe content on the Service infringes your copyright, please send a notice to legal@nourishnest.app with: (a) a description of the copyrighted work, (b) identification of the infringing material, (c) your contact information, (d) a statement of good faith belief, and (e) a statement under penalty of perjury that you are the copyright owner.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NourishNest regarding the Service and supersede all prior agreements.
